About the Parties:
EdiZONE is a
developer of products and technology. Its business model is to conceive and
patent unique and valuable technologies and product designs, develop them into
prototype products, and then license them to a leader in the applicable
marketplace.
Sunrise Medical manufactures and distributes
homecare and extended care products. The company offers manual and powered
wheelchairs, pediatric wheelchairs, seating and positioning products, standard
wheelchairs, and custom rehabilitation and sports products, as well as clothing
and accessories. The company was formerly known as RichMed, Inc. and changed
its name to Sunrise Medical, Inc. in 1983. It operates as a subsidiary of
V.S.M. Investors, LLC.
As in Complaint:
Plaintiff alleges that defendant markets and manufactures Jay® Seating Products that
include a fluid pad or cushioning component which includes microspheres and a lubricating
substance such that the composition does not flow under gravity like a liquid
but instead easily deforms under pressure and then stays in position until pressure
is applied to deform it in a different way, thereby conforming to the user of
the seating product, that infringes the above patents.
Other Cases Filed:
Plaintiff
has recently filed case (2:12-cv-01219)
against Blue Chip Medical Products on December 31, 2012, which is
pending.
