Lawsuit against Hyundai Motor for Vehicle Controlling System



Plaintiff: American Vehicular Sciences (AVS)

Defendants: Hyundai Motor Company, Hyundai Motor America and Hyundai Motor Manufacturing Alabama LLC

A patent infringement case (6:13-cv-00270) was filed on Mar 22, 2013 in the Texas Eastern District Court. The patents involved in this case are as follows:


  • US7413048 - Weight measuring systems and methods for vehicles, issued on Aug 19, 2008.
  • US7976060 - Seat load or displacement measuring system for occupant restraint system control, issued on Jul 12, 2011
  • US8235416 - Arrangement for sensing weight of an occupying item in a vehicular seat, issued on Aug 07, 2012

All the three patents were issued to David Breed and expire[i] on Jun 07, 2015. These patents are currently assigned[ii] to American Vehicular Sciences (source: MaxVal’s Assignment Database.)

The complaint says that defendant is manufacturing vehicles including various models of Hyundai’s Elantra product, which include systems and employ methods for determining the weight of an occupying item of a seat that infringe the claims covered in the above patents.
