Acer, Digitech End Patent Dispute

Case Summary:

Digitech filed a patent infringement suit against Acer alleging that the patent covering a digital image processing technology was infringed. The patent involved in the suit US6128415 entitled ‘Device profiles for use in a digital image processing system’ was issued on Oct 03, 2000 and expires[i] by Sep 06 2016. The patent was originally assigned to Polaroid Corp. and is currently assigned[ii] to Digitech Image Technologies (source: MaxVal’s Assignment Database). 


The complaint stated that defendant infringes the patent by manufacturing devices comprising a method to capture/transform the processed image as claimed in the ‘415 patent. The complaint sought money damages and all other relief to which the Court may deem the plaintiff entitled.


It appears that the parties have settled the case amongst themselves and filed a joint stipulation to dismiss the case. Pursuant to the dismissal filed, Judge ordered all claims against Acer and counterclaims against Digitech to be dismissed with prejudice, with each party bearing their costs and expenses incurred. Further details about the settlement were not disclosed.
