Amazon Exits Hopewell Suit over Double-Click Patent

Case Summary:
Hopewell Culture & Design filed a complaint accusing Amazon of infringing its patent that allows users to double click on content on their mobile phones. The suit revolves around the patent: US7171625, entitled ‘Double-clicking a point-and-click user interface apparatus to enable a new interaction with content represented by an active visual display element’ which was originally assigned to Actify at issue on Jan 30, 2007 and expiring[i] by Jun 18, 2022. Todo Partners is the current assignee[ii] of the patent (source: MaxVal’s Assignment Database). According to the complaint Hopewell holds an exclusive license of the patent and possesses the right to sue for infringement and recover past damages.

Plaintiff alleged that the defendant infringed the ‘625 patent by using the patented technology, that allows an user to double click or double tap a visual element representing interactive content and interact with a  second version of the interactive content. Plaintiff cited Amazon Kindle Fire and Amazon Kindle Fire HD as the infringing products.
Hopewell filed motion to dismiss its claims against Amazon with prejudice, considering which the Court granted Hopewell’s motion. Each party will bear their own costs and expenses.  

Hopewell also filed suits against Barnes & Noble, Nokia, Samsung, Adobe, HTC, Opera, Samsung, Acer, ZTE, Microsoft, Motorola and few others asserting the same patent.
