The patents
describe a system for communicating data securely. The complaint alleged that Walmart
infringed one or more claims of the patents literally or under the doctrine of
equivalents, by manufacturing products, devices, systems, and/or components of
systems that embody the patented invention including Walmart smartphone applications.
A joint
stipulated motion for dismissal with prejudice of claims was filed by Maxim and
Walmart. Based upon the stipulation of
dismissal, the Court ordered all claims brought by Maxim against Walmart and
all counterclaims brought by Walmart against Maxim as dismissed with prejudice,
with each party bearing its own costs, expenses and attorneys' fees.
