1Num Ends Litigation over Google Voice

Case Filed: Jan 31, 2014

Case Closed: May 13, 2014

Court: Indiana Southern District Court

Judge: Richard L. Young

Case Summary:

Anderson, Indiana-based company One Number Corporation (1Num), a provider of edge hosted voice and messaging solutions filed a case alleging that Google infringed a patent relating to communication systems.

Patent-in-suit:
At issue was the patent US8611511 entitled ‘Contact number encapsulation system,’ issued on Dec 17, 2013 and expiring[i] by Jan 10, 2028. 1Num is the current assignee[ii] of the patent (source: MaxVal’s Assignment Database.)

The invention describes a method and system for allowing telephone users to cause multiple phone lines to ring when a calling party dials a single primary contact number, thereby eliminating the need for providing multiple contact numbers to third parties.

1Num Claims:
The complaint stated that Google has willfully infringed the ‘511 patent by making, selling and using contact number encapsulation system that embodies the patented invention. The accused product is the Google Voice service that allows giving everyone one phone number and forwarding it to multiple phones, which means the phone number stays the same for those trying to reach the recipients.

Case Conclusion:
The court granted joint motion to stay all pending deadlines as the parties have agreed to settle the case. Parties requested additional time to formalize and draft settlement documents.  In May, 1Num filed stipulation of dismissal, pursuant to which the court granted the stipulation, ordering all claims raised by plaintiff dismissed with prejudice and counterclaims raised by defendant dismissed without prejudice. Each party will bear its own respective costs and attorney’s fees. Further terms of settlement were not disclosed in the court documents.

Other cases by 1Num:
One other case filed against Google asserting two other U.S patents citing Google Voice services was closed.
