Aspen Medical Products Targets Novitas Medical



On Wednesday, October 16, 2012, Aspen (plaintiff) launched a complaint against Novitas (defendant) for patent infringement in the U.S. District Court of California (case no. 2:12-cv-08733).

Aspen Medical Products develops spinal bracing for post-trauma stabilization, pre- and post-surgical stabilization, pain management and long-term patient care. Novitas Medical is a medical device manufacturer and their products include devices for DVT prevention, contrast therapy, and orthopedic bracing.

The patent USD636494 involved in this suit is currently assigned[i] to Aspen (Source: MaxVal’s Assignment Database). The patent entitled Lumbar belt was issued on April 19, 2011 and expires[ii] on July 01, 2029. The lumbar belt design covered by the patent USD636494 is shown in Fig.1.

According to the complaint, defendant’s Sequoia products as shown in Fig. 2 resemble the design covered by the patent USD636494.
