Case Summary:

Kaavo, Inc. a Texas based Cloud computing company engaged in developing and sale of software for IT resource management filed a case against Hewlett – Packard (HP), a California based Delaware Corporation engaged in developing and manufacturing computing devices, accusing them of infringing upon one of Kaavo’s U.S patents.

The ‘974 patent relates to methods, devices, and systems related to management of a cloud computing environment for use by a software application.

As in Complaint:

The complaint alleged that HP infringed the '974 patent by making, using, selling, offering to sell, and/or importing "HP Cloud Application PaaS" that are covered by one or more claims of the '974 patent. The infringing aspects were indicated as the software application which is used in HP’s methods and systems for management of a cloud computing environment.

Kaavo adds that it has been damaged by the foregoing acts of infringement of its patents by the defendant and will continue to be damaged by such infringement unless enjoined by this Court.

District Court Judgment:

Kaavo and HP filed joint stipulation for dismissal and accordingly, Court ordered dismissal with prejudice of all claims and counterclaims asserted by either party with all costs and fees to be incurred by the respective parties, thereby ending the dispute.

Linex Appeals for New Trial in Wireless Patent Suit against HP, Apple and Others

Case Summary:
Linex Technologies, a Florida-based developer of 3G/4G/LTE+ systems architecture and patent licensing company has filed an appeal in the Federal Circuit concerning district court’s judgment invalidating Linex’s patent claims. The suit was filed in Jan, 2013 against Delaware corporations namely HP, Aruba Networks, Meru Networks and Ruckus Wireless, and Apple, a California corporation. The suit was originally filed in Delaware District Court and later transferred to California Northern District Court. The patents-in-suit relate to the field of wireless data transmission and spread spectrum technology.
Patents-in-Suit:
The suit revolves around the patents:

  • US6757322 entitled ‘Space diversity and coding, spread-spectrum antenna and method,’ issued on Jun 29, 2004
  • RE42219 entitled ‘Multiple-input multiple-output (MIMO) spread spectrum system and method,’ issued on Mar 15, 2011

Both the patents expire[i] on Nov 24, 2018 and are currently assigned[ii] to Linex (source: MaxVal’s Assignment Database).The ‘322 and ‘219 patents relate to antennas and more particularly to reduce the effects of shadowing from a multipath environment using space diversity and coding.
As in Complaint:
The suit alleged that defendants’ products operate using certain wireless communication methods that operate in a “multiple input, multiple output” (“MIMO”) mode over a wireless local area network, as defined in the IEEE 802.11n standard, which infringe the asserted patents. Linex asked court to enjoin and obtain damages resulting from defendants’ unauthorized manufacture of products, methods, processes, services, and/or systems that infringe one or more claims.
District Court Judgment:
At some point during the proceeding, the ‘322 patent was dropped by Linex and reissue patent RE43812 entitled ‘Multiple-input multiple-output (MIMO) spread-spectrum system and method’ was included.
The parties requested court to construe a number of disputed claim terms and defendants also filed motions for summary judgment on invalidity and non-infringement. Since the claim construction and summary judgment hearing, a number of the asserted claims have been dismissed with prejudice and defendants’ motion on invalidity in part and non-infringement on the remaining valid claims were granted. The court order concluded that:

  • claims 107-109 of the ‘219 patent and claims 97-98 of the ‘812 patent are invalid
  • claims 121, 131-132 of the ‘219 patent and claims 101-102 of the ‘812 patent are valid, but are not infringed by the accused devices.

Accordingly, in May 2014, court entered its judgment favoring defendants HP, Apple, Aruba Networks, Meru Networks and Ruckus Wireless. The defendants were then entitled to attorneys’ fees and other litigation expenses.

HP and Others Settle Suit with NovelPoint over Location Services

Case Summary:
NovelPoint Security filed a complaint accusing HP of infringing its US patent US6442485 entitled ‘Method and apparatus for an automatic vehicle location, collision notification, and synthetic voice’, which was legally issued on Aug 27, 2002 and expiring[i] by Jun 12, 2020. The patent is currently assigned[ii] to NovelPoint Security (source: MaxVal’s Assignment Database). The patent relates to a controller with a memory, a Global Positioning System and means for wireless communication connectively disposed within a vehicle.

The Court documents said, defendant infringed the claims of patent-in-suit by making use of the products and/or methods encompassed by claims of the ‘485 patent and cites Veer 4G smartphone as an example of infringing product/method.

The case initially proceeded with HP and later defendants including Acer, Pantech Wireless, Lenovo, Dell, Huawei Device, Coolpad Technologies and Personal Communications Devices were consolidated to this case.

It seems that all the parties settled the case with NovelPoint and filed a joint motion for dismissal. Upon consideration, the Court ordered all claims be dismissed with prejudice. No information on the terms of settlement is available. Each party will bear their own costs and expenses.

So far, NovelPoint has filed nearly 46 cases asserting the same patent against companies such as Sony, Honda, BMW, Hyundai, Mercedes-Benz USA, etc.

HP, Online News Link Settle Suit over Internet Links

Case Summary:

A patent infringement suit was filed by Online News Link against HP claiming that three of their patents that describe a method of inserting links into online newspapers and other media were infringed. The patents in suit were: US7508789, US7181758 and US8457545 all entitled Information distribution and processing system. The patents were legally issued on Mar 24, 2009, Feb 20, 2007 and Jun 04, 2013, respectively. The ‘789 and ‘545 patents expire* by Apr 07, 2014 and ‘758 patent expires* by Jul 25, 2014. Online News Link is the current assignee+ of the patents-in-suit (source: MaxVal’s Assignment Database).

In the complaint, plaintiff alleged that HP infringed the above patents by making use of the patented technology of information distribution system(s) that transmit(s) email communications containing user-selectable links associated with data on a server. Plaintiff sought judgment in favor, permanent injunction, damages, costs and expenses incurred.

The parties announced Court that they have settled the case among themselves, after which stipulation of dismissal was filed by Online News Link on Oct 18. Upon consideration, the Court granted motion and ordered dismissal with prejudice, thereby closing the case. Each party will bear their own costs and expenses. Further details of the settlement were not disclosed.

Texas Court Dismisses Suit against HP by NovelPoint Security

Case Summary:
NovelPoint lodged a complaint against HP accusing them of infringing two patents that relates to a computer security system. The patents in question were:

US5434562 entitled Method for limiting computer access to peripheral devices issued on Jul 18, 1995 and expired* on Jul 18, 2012

US6212635 entitled Network security system allowing access and modification to a security subsystem after initial installation when a master token is in place issued on Apr 03, 2001 and expiring* by Jul 14, 2018.

The patents were last assigned+ to NovelPoint (source: MaxVal’s Assignment Database). As per the complaint, defendant manufactures computers that utilize a method, providing security for computers in manner claimed in the ‘562 and ‘635 patents. The company cites HP EliteBook 8760w Mobile Workstation, HPCompaq dc5700 Small Form Factor PC, HP xw8600 Workstation and HP Compaq 6910p Notebook PC as the infringing products. Plaintiff sought judgment in favor, permanent injunction, damages, costs and expenses incurred. 

The patent dispute between the parties is resolved as stipulated motion for dismissal was filed by both plaintiff and defendant. Having considered the request, the Court ordered all claims against HP to be dismissed with prejudice and counterclaims against NovelPoint to be dismissed without prejudice with no charges imposed on any parties.

Apple wins over case filed by Optimum Power Solutions



In 2011, Optimum Power Solutions filed a complaint 3:11-cv-01509 against Apple, Dell, HP, Lenovo and Sony Electronics for their infringement of various claims of the U.S. Pat. No. 5,781,784 entitled ‘Dynamic power management of solid-state memories’ that issued on July 14, 1998. This post briefly summarizes the verdict rendered in this case on March 19, 2013.

The infringing products as said in complaint were Apple MacBook Pro, Dell Studio1555 Notebook, HP Pavillion dv3-2150us notebook, Lenovo ThinkPad T500 and Sony Vaio Z notebook. 

The case initially started with 5 defendants who were then reduced to 1 due to the dismissal of 4 defendants in September 2011 and the case proceeded to trial with Apple as sole defendant. In the final verdict, Optimum Power Solutions lost on all its claims as Judge, William H. Alsup, ordered non-infringement of the patent in favor of Apple and dismissal of the case without prejudice.

The ‘784 patent expired on Jul 2012, when the case was in hearing, and it appears that the plaintiff may not appeal the verdict.
