Lawsuit Summary - Kroy IP vs. Kroger

Defendant: Kroger Co.


A patent infringement case (2:13-cv-00141) is filed in Texas Eastern District Court by Kroy IP Holdings against Kroger on Feb 18th. This case involves the patent US7054830 (System and Method for Incentive Programs and Award Fulfillment), which is currently assigned[i] to Kroy IP Holdings (source: MaxVal’s Assignment Database). The patent particularly relates to a method of conducting incentive programs over internet.


The complaint alleges that the defendant is offering an incentive program, which is identical to the incentive program claimed in the ‘830 patent by the plaintiffs. An online database is maintained by defendant’s host computer allowing customers to keep track of their accumulated points. The application in the host computer that provides reward fulfillment options to each customer based on their account information, infringes the above patent.
