Raymond Corporation Sued over Marketing Methods

Defendant: The Raymond Corporation

A patent infringement case (6:13-cv-00162) was filed by Clear With Computers against Raymond Corporation in the Texas Eastern District Court on Feb 19th

The patents-in-suit are US7606739 (Electronic Proposal Preparation System) and US5625776 (Electronic Proposal Preparation System for Selling Computer Equipment and Copy Machines) and they are currently assigned[i] to Clear with Computers (source: Maxval's Assignment Database). Further the ‘739 patent expired as of May 5th 2012, the plaintiff had petitioned for PTA recalculation which has been dismissed by USPTO.

The patents relates to a system for creating a customized proposal by linking together product pictures, optional environment pictures showing environments in which the product may be used, and text related to the product. The system includes means for linking together predetermined product pictures, optional environment pictures, and text based upon a potential customer's answers to predetermined queries.  

The complaint alleges that the defendant uses the marketing methods that are covered by the claims of the ‘776 and ‘739 patent, including www.rangerboats.com and all related instrumentalities used to deliver web pages from that domain, including related web servers and database servers and their associated software.

The plaintiff has filed other infringement suits (6:13-cv-00161 Fishing Holdings, 6:13-cv-00163 Salford, 6:13-cv-00164 Textron, 6:13-cv-00165 Universal Forest Products, 6:13-cv-00166 Valmont Industries, 6:13-cv-00167 Vermeer Corporation, 6:13-cv-00168 Yanmar America Corporation, 6:13-cv-00169 Alamo Group, 6:13-cv-00170 Alcoa) on the same day asserting the same patents.
