The eTagz patents in the suit involve product marketing and branding through the use of a digital labeling system including a CD, DVD, CD-ROM, memory card, USB flash drive or other digital communication device. Use of digital labeling system creates unique marketing opportunities for vendors and manufacturers. Information about the manufacturer such as branding, product lines, multimedia presentations and interactivity with purchasers are some of the benefits that can be obtained by employing a digital labeling system.

The Parties:
eTagz, a digital media company, provides marketing and branding tags with retail products. It provides digital hang tags containing media content for consumers, such as videos, games, music, and promotions. It develops CD-ROMs of video games for convenience stores to promote sales of fountain drinks. It serves manufacturers, retailers, and advertisers. 

Magnus is in the business of marketing hunting products under brand names including its own Magnus brand.

As in complaint:
Plaintiff alleges that defendant infringes the above patents by marketing the product Bullhead with features as claimed in the above patents. They also state that all the defendants’ products that include a computer readable medium infringe the eTagz patents.
